By Accepting the terms & conditions of this auction you acknowledge you are entering into a legal and binding contract. 

Regular internet bidding fees will apply - 2% of purchase price to a maximum $500 fee per parcel. Bidders must register in order to be eligible to bid.

A non-refundable deposit of 10% will be required from the buyer after bidding closes. Balance of the purchase price must be paid prior to possession date. 2014 property taxes to be paid by Seller. Possession to be December 1, 2014. Buyer and Seller will be responsible for their own legal fees.

- PROPERTY TO BE SOLD WITHOUT WARRANTY.  All dimensions and descriptions are approximations only based upon the best information available and are subject to possible variation. Sketches may not be drawn to scale and photographs may not depict the current condition of the property. Bidders should inspect the property and also review all the pertinent documents and information available, as each bidder is responsible for evaluation of the property and shall not rely upon the Seller, Broker or Auctioneer, their Employees or Agents. The property will be sold AS IS and without any warranties or representations, express or implied.

- ENVIRONMENTAL DISCLAIMER. The Seller, Broker and Auctioneers do not warrant with respect to the existence or nonexistence of any pollutants, contaminants or hazardous waste prohibited by federal, provincial or local law. Buyer is responsible for inspection of the property prior to purchase for conditions including but not limited to water quality, seepage, septic and sewer operation and condition, radon gas, asbestos, presence of lead based paint, and any and all structural or environmental conditions that may affect the usability or value of the property. No warranties are made as to the existence or nonexistence of water wells on the property, or the condition of any wells.

- SELLER'S PERFORMANCE. The Seller has agreed to the terms of the sale as published. However, the Broker and Auctioneer make no warranties or guarantees as to the Seller's performance.
- AGENCY DISCLOSURE: KRAMER AUCTIONS - REAL ESTATE DIVISION INC and/or NEIL KRAMER AUCTION SALES LTD. is representing the Seller and will be paid by the seller.

ADDITIONAL CONDITIONS:

(1) You agree to forward payment for all online purchases in Canadian Funds via wire transfer, certified cheque or Bank draft within 1 banking day of receipt of invoice. Please contact our office at 306-445-5000 to arrange for wire transfers.  Payments will be sent to Kramer Auctions Ltd., Box 1807, North Battleford, Saskatchewan, Canada, S9A 3W8.

You agree that all sales are final.

(2) Registration to Participate in our online auctions. Upon our acceptance of your completed registration and receipt of your bank letter of reference, the username (email address) and password you created upon registration will be activated and become your PERMANENT online username (email address)  and password which will identify you whenever you place bids using our Online Bidding Services. The username (email address) and password you create will be enabled for you to log on and bid Live Online at all future Kramer Auctions Ltd. online auctions. PROTECT AND KEEP CONFIDENTIAL YOUR USERNAME (EMAIL ADDRESS) AND PASSWORD. By acceptance of these terms and conditions you agree to be held financially responsible for any and all purchases made using your username. We reserve the right, in our sole discretion, to allow or deny access to our Online Bidding Services to any party or to revoke any username (email address) and password at any time.

Important: A formal letter of credit is not required but we do require a Letter of Reference from your Financial Institution on letterhead with a date and signature of the contact person, stating you are a customer in good standing.  Your Letter of Reference will remain valid until the end of the calendar year.  Upon expiration, you will need to submit a Letter of Reference for the new calendar year.  There are no exceptions to this as this letter is used to verify your registration and prevent false registrations and registrations by minors. Please have your financial institution fax the letter to Kramer Auctions Ltd. @ 306 445 5003.

(3) You are solely responsible for the accuracy of your Bidder Information and you hereby warrant that your Bidder Information is true and accurate. You hereby certify you are of legal age, possess the legal capacity and the financial means to participate in the online auctions.

(4) You acknowledge that Kramer Auctions Ltd. and its employees act merely as agents for sellers. No warranties are expressed or implied as to any items being sold and you agree to purchase and accept the item in an as-is condition. We obtain information on items from the sellers and you hereby agree to hold harmless Kramer Auctions Ltd. and its employees for any errors or omissions regarding the properties(s) being sold. This information includes but is not limited to general description, year, physical condition, features and other data pertinent to the value of the item. ALL ITEMS ARE SOLD AS-IS WHERE-IS

(5) You acknowledge that you have the right and responsibility to inspect the item(s) yourself or to have a third party representative inspect the item(s) for you. That by bidding on an item you have agreed to accept that item in it's present condition and with the description provided whether accurate or not.

(6) You agree that by using our Online Bidding Services to bid on a particular item, this is a firm commitment to purchase said item(s) and may not be cancelled or retracted for any reason. You also acknowledge that the Internet may be an unreliable and error prone network, and Kramer Auctions Ltd. will not guarantee that bids placed online will always be transmitted to or received by the auctioneer in a timely fashion. You agree to hold Kramer Auctions Ltd. harmless for any interruptions in online bidding. Further, the auctioneer has the sole discretion to accept or refuse any bid. Kramer Auctions Ltd. retains the right, at our sole discretion, to add, delete or change some or all of our online services and the terms and conditions governing their online auctions at any time without notice. 

(7)When using our online auction services you are making firm commitments to purchase said item(s) and are entering into a legal and binding contract.  Bids may not be cancelled or retracted for any reason.   You agree that the username you are bidding with and that the name registered with that username is the name that is solely responsible for payment and that name will appear on all invoice documentation. Kramer Auctions Ltd. will not accept payment from anyone other than that person who has registered and has been approved under that name,username and password and who has bid online with that username.

(8) You acknowledge and agree that Kramer Auctions Ltd., their web sites, and any software and information used in connection the.rewith contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that any content contained on their web sites is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.

Kramer Auctions Ltd. has gone to great lengths  and expense to ensure your online auction experience is as rewarding and competitive as being there in person
