By Accepting the terms & conditions of this auction you acknowledge you are entering into a legal and binding contract. With regard to Real Estate Auctions, be sure to read the Terms and Conditions of EACH sale as appears on the Kramer Auction website. Throughout the following, references are also made to Real Estate where exceptions to the default conditions may exist. PLEASE READ WITH CARE.
(1)Payment is due the day after the sale, except for Real Estate Auctions where a deposit is required (as stipulated in the Terms & Conditions of each sale) the day of the sale or as soon as possible thereafter, and the balance of funds prior to Completion/Possession Day (by default 30 days after the auction or as may be otherwise stipulated in the Terms & Conditions of each sale). To help defray part of the costs of operating the Online bidding service we have instituted a convenience charge for internet bidders. 2% Internet Premium will be applied to each lot / parcel purchased on the internet with a cap of $500.00 per lot / parcel or a minimum $25 charge per lot / parcel. Federal GST and corresponding Provincial Sales Tax will apply to all purchases where applicable. No Items will be released/or retrieved until full payment clears our office. Absolutely no exceptions. You agree to forward payment (or deposit as may apply to Real Estate transactions) for all online purchases in Canadian Funds via wire transfer, certified cheque or Bank draft within 1 banking day of receipt of invoice (or close of auction as may apply to Real Estate). You agree that all sales are final. Upon your becoming the Purchaser of an item, that item shall immediately become your responsibility and be at your risk (whether you have paid for that item or not). In the case of a Real Estate Auction, the property remains the responsibility of the Seller until Completion Day / Possession Date. You agree that Kramer Auctions Ltd. and its employees are not responsible for lost, stolen or damaged items and will not reimburse or discount items for any type of loss. Items must be removed within 5 days of the auction, unless further arrangements are made with the seller. All items are left at your own risk & responsibility.
(2) Registration to Participate in our online auctions. Upon our acceptance of your completed registration and receipt of your bank letter of reference, the username (email address) and password you created upon registration will be activated and become your PERMANENT online username (email address) and password which will identify you whenever you place bids using our Online Bidding Services. The username (email address) and password you create will be enabled for you to log on and bid Live Online at all future Kramer Auctions Ltd. online auctions. PROTECT AND KEEP CONFIDENTIAL YOUR USERNAME (EMAIL ADDRESS) AND PASSWORD. By acceptance of these terms and conditions you agree to be held financially responsible for any and all purchases made using your username. We reserve the right, in our sole discretion, to allow or deny access to our Online Bidding Services to any party or to revoke any username (email address) and password at any time.
Important: A formal letter of credit is not required but we do require a Letter of Reference from your Financial Institution on letterhead with a date and signature of the contact person, stating you are a customer in good standing. Your Letter of Reference will remain valid until the end of the calendar year. Upon expiration, you will need to submit a Letter of Reference for the new calendar year. There are no exceptions to this as this letter is used to verify your registration and prevent false registrations and registrations by minors. Please have your financial institution fax the letter to Kramer Auctions Ltd. @ 306 445 5003. The letter can also be emailed to info@kramerauction.com.
(3) You are solely responsible for the accuracy of your Bidder Information and you hereby warrant that your Bidder Information is true and accurate. You hereby certify you are of legal age, possess the legal capacity and the financial means to participate in the online auctions.
(4) You acknowledge that Kramer Auctions Ltd. and its employees act merely as agents for sellers. No warranties are expressed or implied as to any items being sold and you agree to purchase and accept the item in an as-is condition. We obtain information on items from the sellers and you hereby agree to hold harmless Kramer Auctions Ltd. and its employees for any errors or omissions regarding the item(s) being sold. This information includes but is not limited to year, model, machine or engine hours, physical condition, options, features and other data pertinent to the value of the item, as well as all information related to sizes, dimensions, area measurements (including sq ft., acres/hectares) of real estate properties. ALL ITEMS ARE SOLD AS-IS WHERE-IS.
(5) You acknowledge that you have the right and responsibility to inspect the item(s) or property(ies) yourself or to have a third party representative inspect the item(s) or property(ies) for you. That by bidding on an item or property you have agreed to accept that item or property in it's present condition and with the description provided whether accurate or not.
(6) You agree that by using our Online Bidding Services to bid on a particular item or property, this is a firm commitment to purchase said item(s) or property(ies) and may not be cancelled or retracted for any reason. You also acknowledge that the Internet may be an unreliable and error prone network, and Kramer Auctions Ltd. will not guarantee that bids placed online will always be transmitted to or received by the auctioneer in a timely fashion. You agree to hold Kramer Auctions Ltd. harmless for any interruptions in online bidding. Further, the auctioneer has the sole discretion to accept or refuse any bid. Kramer Auctions Ltd. retains the right, at our sole discretion, to add, delete or change some or all of our online services and the terms and conditions governing their online auctions at any time without notice.
(7) When using our online auction services you are making firm commitments to purchase said item(s) or property(ies) and are entering into a legal and binding contract. Bids may not be cancelled or retracted for any reason. You agree that the username you are bidding with and that the name registered with that username is the name that is solely responsible for payment and that name will appear on all invoice documentation. Kramer Auctions Ltd. will not accept payment from anyone other than that person who has registered and has been approved under that name, username and password and who has bid online with that username.
(8) You acknowledge and agree that Kramer Auctions Ltd., their web sites, and any software and information used in connection therewith contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that any content contained on their web sites is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.
(9) Every person at the Auction site before, during and after the auction sale shall be deemed to be there at their own risk with notice of the condition of the premises, the activities on the premises, and conduct of the third parties and the Bidder shall advise his agents and employees.
